Agreement

By downloading, creating an account for, or using BeLuMae, you agree to these Terms and the Privacy Notice. If you use BeLuMae for a studio or other business, you confirm that you have authority to accept these Terms for that business. If you do not agree, do not use the app.

The service

BeLuMae is a local-first mobile tool for studio client records, appointment history, notes, result photos, and lash mapping. Free records are stored on the user’s device. Optional Pro features may include an account, unlimited records, cloud backup, and restoration.

BeLuMae is a recordkeeping tool, not medical, legal, tax, accounting, safety, or other professional advice. It does not replace a studio’s consent process, legal obligations, independent backups, or professional judgement.

Eligibility and app-store rules

You must be legally able to enter into these Terms and comply with the rules of the Apple App Store or Google Play store through which you obtain BeLuMae. Store terms also apply to downloads, purchases, renewals, refunds, and device eligibility. If store terms conflict with these Terms on a matter controlled by the store, the store terms govern that matter.

Your records and responsibilities

You retain rights in content you create or upload. You are responsible for its accuracy, lawfulness, and permissions. Before recording client information or a photo, you must provide any required notice and obtain any consent or other lawful basis required in your location.

Do not use BeLuMae to store medical information, health histories, allergy records, identity documents, payment-card details, or other unnecessary sensitive information. Do not upload unlawful, harmful, infringing, or deceptive content.

Free and Pro

Free currently supports up to five active clients and five appointments for each client, stored locally on the device. Pro is intended to remove those creation limits and add cloud backup and restoration. Features and limits presented in the app at the time of use form part of these Terms.

Cloud features require a supported device, internet access, a valid BeLuMae account, and an active Pro entitlement. Cancelling Pro does not automatically delete records already stored on the device.

Subscriptions, cancellation, and refunds

Apple or Google processes subscriptions, taxes, receipts, renewals, cancellation, and refunds. The final local price and billing period appear in the store purchase screen before confirmation. Subscriptions renew automatically unless cancelled through the relevant store settings before renewal.

Cancellation normally takes effect at the end of the current paid period. Refund requests are handled under the rules and consumer protections applicable to the store and the user’s location. Deleting a BeLuMae account or app does not by itself cancel an active store subscription.

Licence and intellectual property

Subject to these Terms, BeLuMae grants you a limited, personal or internal-business, non-exclusive, non-transferable, revocable licence to use the app on supported devices. BeLuMae and its licensors retain rights in the app, branding, design, documentation, and software.

You grant BeLuMae only the limited permission needed to process, transmit, store, back up, restore, and display your content to provide and secure the features you choose. We do not acquire ownership of studio or client content.

Acceptable use

Do not attempt to access another user’s records, bypass security or capacity controls, reverse engineer the app except where law expressly permits it, interfere with the service, introduce malicious code, abuse support or early-access programmes, or use BeLuMae for unlawful surveillance, spam, or infringement.

Availability, updates, and backups

The app is designed to work offline, but no device, app, network, or cloud backup can be guaranteed uninterrupted, error-free, or immune from data loss. Keep device backups and exports suitable for your business. We may provide updates, maintenance, security changes, or feature changes and may stop supporting obsolete versions or platforms with reasonable notice where practical.

Suspension and closure

You may stop using Free at any time and can delete local records in the app. Pro users can request account deletion and should separately cancel any store subscription. We may restrict cloud access where reasonably necessary for security, unlawful use, non-payment, abuse, or a material breach of these Terms.

Disclaimers and liability

To the maximum extent permitted by law, BeLuMae is provided “as is” and “as available.” We do not promise that records will be complete, that a particular device will remain supported, or that the service will meet every studio’s regulatory requirements.

Nothing in these Terms excludes rights or liability that cannot legally be excluded. Where law permits a limit, BeLuMae’s total liability arising from the service will not exceed the amount paid for BeLuMae in the 12 months before the event giving rise to the claim. This limit does not apply where prohibited, including liability for fraud, wilful misconduct, gross negligence, or death or personal injury caused by negligence where such liability cannot be limited.

Governing law and disputes

These Terms are governed by the laws of South Africa. South African courts have jurisdiction, but this does not remove mandatory consumer rights or remedies that apply in the user’s country of residence. Before starting formal proceedings, please contact us so we can try to resolve the issue in good faith.

Changes to these Terms

We may update these Terms to reflect product, legal, or provider changes. The updated version will be posted with a new effective date. Where required, we will give additional notice or request renewed acceptance. Continued use after an effective update means acceptance to the extent allowed by law.
